Terms & Conditions for Usage of JP Remit
(with JP Remit membership registration)

The Terms & Conditions for usage of JP Remit (with JP Remit membership registration) (hereinafter referred to as "T&C") comes in effect since March 31, 2012. Foreign money transfer transactions carried out through JP Remit shall be handled in compliance with the T&C. Unless the T&C are agreed, JP Remit shall not be utilized. In the meantime, the T&C are regarded to be agreed, once JP Remit is used.

Throughout the T&C, the words of "Our Company" or "We" means Japan Remit Finance Co., Ltd. (hereinafter referred to as "JRF"), or its management and employees. "Customers" or "Customer" is defined as those who request us to transfer money and/or receive money transferred through JP Remit.

1. Scope of Service

JRF electronically transfers funds in cash to the designated countries world-wide.
"User" is defined as a user of JP Remit and "Beneficiary" means a recipient to receive money through JP Remit.
"Country of Destination" is a country where a Beneficiary receives money transferred through JP Remit.
"Transaction" is the detailed money transfer instructions stipulated by the User, and "Transaction Amount" is the amount of money prescribed by the User to be transferred to the Beneficiary, which is net of any applicable service fee charged by JRF, and before any conversion into any other currency. In accordance with the Act on Settlement (2009; Law No. 59), the Transaction Amount shall not exceed any amount greater than JPY 1,000,000 (one million Japanese Yen) per one money transfer request. "Payout Amount" is the net of tax amount which a Beneficiary receives in accordance with regulations in a Country of Destination.

2. Use of JP Remit

  1. Qualification of Users: A Customer is requested to have an age over 18 years old, and to form a legally binding contract in the applicable laws. Some other restriction may be from time to time applicable.
  2. JP Remit is a service only for those residing in Japan.

3. Customer Identification

  1. In accordance with Law for Prevention of Transfer of Criminal Proceeds (2007; Law No. 22), and Foreign Exchange and Foreign Trade Act (1949; Law No. 228), JP Remit shall not be used until a customer identification process is duly completed.
  2. JRF shall screen each Transaction before being processed, as to whether it falls under any kind of payments stipulated in accordance with Article 17 of Foreign Exchange and Foreign Trade Act. JP Remit shall not be used if it eventually falls under Article 17. Further, JRF shall not accept any Transaction related to Payment Restrictions on Trade and/or Restrictions on Use of Funds applied to North Korea and to Restrictions on Use of Funds applied to Iran.

4. Request for Money Transfer

  1. In respect of acceptance of the money transfer, the User shall pay a service fee (hereinafter referred to as "Service Fee") prescribed by us with the Transaction Amount. JRF accepts Japanese Yen only for the payments by the User. The Service Fee prescribed by JRF is below described.
    1. Transaction Fee : Please contact JRF to ask for this fee rate.
    2. Cancellation and Refund Fee (In such cases as where JRF is not able to transfer money because of any defectiveness in the User's application): In principle, no cancellation and refund fee are additionally charged, but we have a policy not to return the Transaction Fee, once paid. JRF shall refund the Transaction Amount to the designated bank account in Japan with its bank remittance charge on JRF.
  2. The User shall pay both the Transaction Amount and the Service Fee to the designated Japanese Yen account of JRF at the bank in Japan with its bank remittance charge on the User.
  3. JRF handles three currencies – Japanese Yen, US Dollar, and Bangladesh Taka.
  4. Foreign Exchange
    Transfer money will normally be paid in the currency of the Country of Destination. The exchange rate applied shall be the rate set by JRF on the basis of various market rates combined. In addition, in cases where the market exchange rate fluctuation is unstable, the applicable rate may be different even in a single day. Please contact JRF to ask for the applicable foreign exchange rate.

5. Payout to Beneficiary

  1. JRF shall transfer money from our domestic Japanese Yen account to an account of the Beneficiary in Bangladesh. Moreover, we shall also handle a cash payout to be picked up by the Beneficiary at the designated locations.
  2. Regular period of money reaching the account of the Beneficiary or for a pick-up by the Beneficiary is one business day, subject to hours of operations of the payment locations.

6. Restriction Clause

  1. Summary: At the sole discretion of JRF, we may restrict the scope of JP Remit on a transactional basis or as a whole. Further, JRF retains a right to modify or suspend our JP Remit service with a prior notice or in some cases without any notice.
  2. Delay : Our collation of Customer's identification, our verification of the Transaction and our compliance rule implementation may cause a delay or a cancellation in transferring money. Those may also affect the hours of operation and/or the currencies that the Users would normally select. At any rate, the Users shall get refunded under a certain circumstance, subject to the T&C.
  3. Illicit Transaction : The User shall not use JP Remit if such laws and regulations (including the T&C) prohibit him or her from transferring money as money-laundering, sexual related goods and services, illegal gambling, money transfer for a fraud and terrorism purpose.
  4. Cutting off Anti-social Forces : When being regarded inappropriate to continue JP Remit service, JRF shall terminate JP Remit service with our notice to the User, who is found to be involved or related to those below itemized.
    1. In a case where JRF realizes that any information provided at the time of application is found false.
    2. In a case where JRF comes to know the User being;
      1. a gang or bouryoku-dan;
      2. a member or associate of gang or bouryoku-dan group;
      3. a company related to gang or bouryoku-dan group;
      4. a corporate racketeer, or a cyber-terrorist;
      5. other similar member or group such as;
        1. controlled by a gang or bouryoku-dan;
        2. substantially controlled by a gang or bouryoku-dan;
        3. exploiting a use of a gang or bouryoku-dan to seek an undue economic interest;
        4. funding a gang or bouryoku-dan; and
        5. maintaining a socially criticized relationship with a gang or bouryoku-dan
    3. In a case where the User conducts those below described;
      1. Undue demands resorting to a violence;
      2. Illegally undue demands;
      3. Threating or violent activities;
      4. Any activities damaging or obstructing JRF by using a power to spread rumors, using fraudulent means; and
      5. Other similar activities in the preceding
  5. Ineligibility : At our sole discretion, we may reject any transaction with certain individual or company as a result of our screening the lists of names provided by the Japan Financial Intelligence center, the US Treasury Departments Office of Foreign Assets Control ("OFAC"), the European Council, and others.
  6. Others : The User is not allowed to enjoy JP Remit service if the User strives to transfer money on behalf of others. If such is the case, the User shall notify JRF that money transfer is to be done on behalf others or for some specific business or group. We shall require the User to provide additional identification and/or information on the specific business or group.
  7. Accuracy : When transactional information is submitted to JRF, the User is requested to ensure such information is accurate at his or her own risk.
  8. Restrictive Deed : The User shall not conduct the following deed in connection with JP Remit service, and our communication with the User, and any third party on behalf of the User.
    1. Violating the T&C or any other contract engaged between other Users and JRF
    2. Providing false, incorrect, and misleading information
    3. Rejecting cooperation for investigation, and JRF's confirmation on customer identification or information already provided by the User
    4. Using an anonymous delegates

7. Personal Information Protection

  1. JRF collects and uses personal data of the User ("Your Information), which the User provides on the application together with other information which is collected or generated during the course of your relationship with JRF, such as transaction and loyalty programs details and your marketing preferences
  2. Personal Information Protection Policy : By agreeing on the T&C when the application is submitted, the User is also deemed to acknowledge and agree on JRF's Personal Information Protection Policy, which is shown in our web site

  3. Disclosure under the Law : JRF may also disclose Your Information to third parties in compliance with applicable laws and/or when requested by the courts.
  4. Information Access : The User acknowledges that JRF retains a right to, directly or through a third party, collate Your Information provided by the User, when reasonably necessary for JRF's operation. Such cases are included that we directly or indirectly collate Your Information to request for additional information, and to confirm the ownership of E-mail address or financial product property.

JRF states the significant matters that should provide important instructions and information in the attachment.

Refund : Without our failure or misconduct to process money transfer, JRF shall not in principle refund. Nonetheless, in cases where the User wishes to request refunds, the refund request should be submitted in writing to on-line inquires, fax number, or postal mail address shown in the past paragraph of the T&C, attaching Your Information including your name, address, registered telephone number, the Transaction Amount, and the reason for refund request. Then, JRF may consider your refund request positively.

Before JRF decides to refund, our confirmation shall be required as to whether money already reaches the account of the Beneficiary or it is already paid out to the Beneficiary at the designated locations. Upon our confirmation, we shall refund the Transaction Amount only to the bank account the User sends money to JRF, provided that JRF simultaneously cancels any other pending money transfer prescribed by the same User. In refunding, we shall not make up any loss or cost incurred due to a change in the foreign exchange rate.

10. Intellectual Property Right

The User acknowledges that the service and product name of JP Remit, trademark, service mark, logos, etc. are all owned by JRF (hereinafter referred to as "JRF's Intellectual Property Right. In addition, the User agrees not to display, use, copy or modify JRF's intellectual Property Right. The User will not infringe any intellectual property right, privacy or other rights of portrait, trade secrets, copy right, and others of JRF or any third party.

11. Disclaimer of Warranty

JP Remit has been on an as-is basis provided without any guarantee, conditions, representation, and implication. No law requests JRF to provide such. JRF, our subsidiary, our employees and our suppliers shall not provide any implied warranty about the relevance of ownership and product for a specific purpose or non-infringement.

12. Loss Compensation

The User acknowledges that any loss caused by i) a violation of the T&C, ii) any improper use of JP Remit and iii) an infringement of the rights of others will be compensated by the User. Such compensation should include any reasonable scale of attorney's fee, and any claims and demands by others. In addition, the User agrees not to damage any of JRF, our subsidiary, our employees/management, and our agent or partner in any manner.

13. Limitation of Liability

Except for claims resulting from a transaction in Japan, JRF, our subsidiary, our employees/ management, and our agent or partner shall be held harmless of any liquidated damage whatsoever for lost profits or not liable for any punitive or incidental liquidated damages directly or indirectly attributed by JRF, our subsidiary, our employees/management, and our agent or partner to losses of any intangible assets including goodwill, trade right, data and so on, in any case, even if JRF has been advised of the possibilities of the damages.

14. Resolutions of Complaints and Conflicts, and Governing Law

  1. Governing Law: The User shall be governed in accordance with the law of Japan. All the actions or inactions relating to JP Remit deemed to have been taken in Japan. Any claims, disputes, controversies, and conflicts (hereinafter referred as to "Claims") shall be treated in accordance with the law of Japan, except for a case where the Code is to regulate the conflicts of laws.
  2. Conflicts with JRF: If any conflicts were to arise between the User and JRF, what we aim at would be to learn and respond to the concerns of the User. Nonetheless, in case where it is asserted that JP Remit does not meet the demands or expectation of the User, JRF shall offer efficient and neutral means to resolute the conflicts swiftly. The User may report the conflicts to JRF's customer service as below described via on-line inquiries or postal mail.

  3. Applicable Law : The T&C shall be governed and construed in accordance with the laws, ordinances and customs of Japan.
  4. Exclusive Jurisdiction : A lawsuit concerning the Transaction between the User and JRF shall be handled with Tokyo District Court as the agreed exclusive court in the first hearing.

15. Supplementary Provisions

  1. Entire Agreement : The T&C constitute the entire agreement between the User and JRF. The T&C supersede and extinguish all prior agreements between the parties.
  2. No Waiver : Even if the User determines not to exercise his or her right as per the T&C, JRF shall not waive such rights thereof. Even when some of provisions of the T&C have been determined invalid by the court of competent jurisdiction or an arbitrator, both the User and JRF shall nonetheless make an effort to enable the T&C to become valid on the basis of the original intent thereof. In addition, the User acknowledges that the T&C and other relevant provisions shall survive and remain in effect.
  3. Changes to the T&C : The Company may from time to time change the T&C, unless otherwise required by laws, without any notice to the User. The User has an invariable access to information about the amended parts in the T&C. The User, who does not agree with those changes, may terminate JP Remit. In the meantime, the User, who continues to use JP Remit after the amended parts come in effect, deemed to accept the changes in the T&C. The User acknowledges his or her attempt not to accept changes or to request for an amendment in the T&C shall become invalid.
  4. Language : In the event that the content of translations into other languages of the Japanese version of these and successive regulations are found to deviate from said Japanese version, the Japanese version shall be taken as correct.
  5. If the User alters specific information already provided for JRF (for instance, a change in his or her address, name, and/or others in the case of an individual User; a change in the name of the company and/or in the address of the head office or principal office in the case of a corporate User), the User is kindly requested to provide amended information without any delay.

16. Security

The security of the User is very important to JRF. We are committed to ensure that your information is safe, while using the security measures. JP Remit is a safe and convenient way of money transfer. For any remittance to those who the User does not know well, we encourage the User to ponder before any remittance. In particular, for a transaction and an offer too good to be true, utmost vigilance shall be required. If you became a target of fraud or if you think there is such a possibility, please contact us. Significant Matters Regarding Instructions and Information

1. Not Foreign Exchange Transactions Carried out by Banks

  • JP Remit is not foreign exchange transactions carried out by banks
  • JP Remit does not accept deposit, savings and time deposits.
  • JP Remit is not subject to the payment of insurance stipulated in Article 53 of the Deposit Insurance Law (1971: Law No. 34), and in Article 55 of Agriculture and Fishery Cooperation Insurance Act (1973: Law No. 53).
  • JRF adequately lodges the depository funds in accordance with Article 43 of the Act on Settlement (2009: Law No. 59).
  • Based upon the Act on Settlement, the User of JP Remit shall be protected with the official depository system.
  • The user of JP Remit is entitled to receive refunds, unless money transfer is completed, by executing his or her right onto the official depository funds in accordance with Article 59 of the Act of Settlement.

2. Other Significant Matters

  • The user is encouraged to carefully read the Terms and Conditions for Usage of JP Remit.
  • The transaction amount shall not exceed any amount greater than JPY 1,000,000 (one million Japanese Yen) per one money transfer request.
  • Regular period of money reaching the account of the beneficiary or for a pick-up by the beneficiary is one business day, subject to hours of operations of the payment locations.

  2. JRF shall screen each Transaction before being processed, as to whether it falls under any kind of payments stipulated in accordance with Article 17 of Foreign Exchange and Foreign Trade Act. JP Remit shall not be used if then eventually falls under the Article. Further, JRF shall not accept any Transaction related to Payment Restrictions on Trade and/or Restrictions on Use of Funds applied to North Korea and to Restrictions on Use of Funds applied to Iran.

If such is the case, the User shall notify JRF that money transfer is to be done on behalf others or for some specific business or group. We shall require the User to provide additional identification and/or information on the specific business or group.
  7. Accuracy : When transactional information is submitted to JRF, the User is requested to ensure such information is accurate at his or her own risk.
  8. Restrictive Deed : The User shall not conduct the following deeds in connection with JP Remit service, and our communication with the User, and any third party on behalf of the User.
    1. Violating the T&C or any other contract engaged between other Users and JRF
    2. Providing false, incorrect, and misleading information
    3. Rejecting cooperation for investigation, and JRF's confirmation on customer identification or information already provided by the User
    4. Using an anonymous delegates

7. Personal Information Protection

  1. JRF collects and uses personal data of the User ("Your Information), which the User provides on the application together with other information which is collected or generated during the course of your relationship with JRF, such as transaction and loyalty programs details and your marketing preferences
  2. Personal Information Protection Policy: By agreeing on the T&C when the application is submitted, the User is also deemed to acknowledge and agree on JRF's Personal Information Protection Policy, which is shown in our web site

  3. Disclosure under the Law : JRF may also disclose Your Information to third parties in compliance with applicable laws and/or when requested by the courts.
  4. Information Access : The User acknowledges that JRF retains a right to, directly or through a third party, collate Your Information provided by the User, when reasonably necessary for JRF's operation. Such cases are included that we directly or indirectly collate Your Information to request for additional information, and to confirm the ownership of E-mail address or financial product property.

Refund : Without our failure or misconduct to process money transfer, JRF shall not in principle refund. Nonetheless, in cases where the User wishes to request refunds, the refund request should be submitted in writing to on-line inquires, fax number, or postal mail address shown in the past paragraph of the T&C, attaching Your Information including your name, address, registered telephone number, the Transaction Amount, and the reason for refund request. Then, JRF may consider your refund request positively.

Before JRF decides to refund, our confirmation shall be required as to whether money already reaches the account of the Beneficiary or it is already paid out to the Beneficiary at the designated locations. Upon our confirmation, we shall refund the Transaction Amount only to be collected by the User at JRF's office, provided that JRF simultaneously cancels any other pending money transfer prescribed by the same User. In refunding, we shall not make up any loss or cost incurred due to a change in the foreign exchange rate.

10. Intellectual Property Right

The User acknowledges that the service and product name of JP Remit, trademark, service mark, logos, etc. are all owned by JRF (hereinafter referred to as "JRF's Intellectual Property Right. In addition, the User agrees not to display, use, copy or modify JRF's intellectual Property Right. The User will not infringe any intellectual property right, privacy or other rights of portrait, trade secrets, copy right, and others of JRF or any third party.

11. Disclaimer of Warranty

JP Remit has been on an as-is basis provided without any guarantee, conditions, representation, and implication. No law requests JRF to provide such. JRF, our subsidiary, our employees and our suppliers shall not provide any implied warranty about the relevance of ownership and product for a specific purpose or non-infringement.

12. Loss Compensation

The User acknowledges that any loss caused by i) a violation of the T&C, ii) any improper use of JP Remit and iii) an infringement of the rights of others will be compensated by the User. Such compensation should include any reasonable scale of attorney's fee, and any claims and demands by others. In addition, the User agrees not to damage any of JRF, our subsidiary, our employees/management, and our agent or partner in any manner.

13. Limitation of Liability

Except for claims resulting from a transaction in Japan, JRF, our subsidiary, our employees/ management, and our agent or partner shall be held harmless of any liquidated damage whatsoever for lost profits or not liable for any punitive or incidental liquidated damages directly or indirectly attributed by JRF, our subsidiary, our employees/management, and our agent or partner to losses of any intangible assets including goodwill, trade right, data and so on, in any case, even if JRF has been advised of the possibilities of the damages.

14. Resolutions of Complaints and Conflicts, and Governing Law

  1. Governing Law: The User shall be governed in accordance with the law of Japan. All the actions or inactions relating to JP Remit deemed to have been taken in Japan. Any claims, disputes, controversies, and conflicts (hereinafter referred as to "Claims") shall be treated in accordance with the law of Japan, except for a case where the Code is to regulate the conflicts of laws.
  2. Conflicts with JRF: If any conflicts were to arise between the User and JRF, what we aim at would be to learn and respond to the concerns of the User. Nonetheless, in case where it is asserted that JP Remit does not meet the demands or expectation of the User, JRF shall offer efficient and neutral means to resolute the conflicts swiftly. The User may report the conflicts to JRF's customer service as below described via on-line inquiries or postal mail.

  3. Applicable Law : The T&C shall be governed and construed in accordance with the laws, ordinances and customs of Japan.
  4. Exclusive Jurisdiction : A lawsuit concerning the Transaction between the User and JRF shall be handled with Tokyo District Court as the agreed exclusive court in the first hearing.

15. Supplementary Provisions

  1. Entire Agreement : The T&C constitute the entire agreement between the User and JRF. The T&C supersede and extinguish all prior agreements between the parties.
  2. No Waiver : Even if the User determines not to exercise his or her right as per the T&C, JRF shall not waive such rights thereof. Even when some of provisions of the T&C have been determined invalid by the court of competent jurisdiction or an arbitrator, both the User and JRF shall nonetheless make an effort to enable the T&C to become valid on the basis of the original intent thereof. In addition, the User acknowledges that the T&C and other relevant provisions shall survive and remain in effect.
  3. Changes to the T&C : The Company may from time to time change the T&C, unless otherwise required by laws, without any notice to the User. The User has an invariable access to information about the amended parts in the T&C. The User, who does not agree with those changes, may terminate JP Remit. In the meantime, the User, who continues to use JP Remit after the amended parts come in effect, deemed to accept the changes in the T&C. The User acknowledges his or her attempt not to accept changes or to request for an amendment in the T&C shall become invalid.
  4. Language : In the event that the content of translations into other languages of the Japanese version of these and successive regulations are found to deviate from said Japanese version, the Japanese version shall be taken as correct.
  5. If the User alters specific information already provided for JRF (for instance, a change in his or her address, name, and/or others in the case of an individual User; a change in the name of the company and/or in the address of the head office or principal office in the case of a corporate User), the User is kindly requested to provide amended information without any delay.

16. Security

The security of the User is very important to JRF. We are committed to ensure that your information is safe, while using the security measures. JP Remit is a safe and convenient way of money transfer. For any remittance to those who the User does not know well, we encourage the User to ponder before any remittance. Significant Matters Regarding Instructions and Information

1. Not Foreign Exchange Transactions Carried out by Banks

  • JP Remit is not foreign exchange transactions carried out by banks
  • JP Remit does not accept deposit, savings and time deposits.
  • JP Remit is not subject to the payment of insurance stipulated in Article 53 of the Deposit Insurance Law (1971: Law No. 34), and in Article 55 of Agriculture and Fishery Cooperation Insurance Act (1973: Law No. 53).
  • JRF adequately lodges the depository funds in accordance with Article 43 of the Act on Settlement (2009: Law No. 59).
  • Based upon the Act on Settlement, the User of JP Remit shall be protected with the official depository system.
  • The user of JP Remit is entitled to receive refunds, unless money transfer is completed, by executing his or her right onto the official depository funds in accordance with Article 59 of the Act of Settlement.

2. Other Significant Matters

  • The user is encouraged to carefully read the Terms and Conditions for Usage of JP Remit.
  • The transaction amount shall not exceed any amount greater than JPY 1,000,000 (one million Japanese Yen) per one money transfer request.
  • Regular period of money reaching the account of the beneficiary or for a pick-up in cash by the beneficiary is one business day, subject to hours of operations of the payment locations.

  • The exchange rate applied shall be the rate set by JRF.
